NSPS Extension Legislation Will See Movement Soon
HPBA-supported legislation, S.1857, will likely see additional consideration by the end of August or in mid-September, depending on the Senate schedule. The legislation, which would extend the effective date of EPA’s NSPS Step 2 regulations from May 15, 2020 to May 15, 2023, might finally move out of the Senate Committee on Environment and Public Works (EPW) during a markup soon. The legislation can only be considered by the full Senate after it has moved out of the EPW Committee through this process.
The bill still needs additional Democratic support to increase the likelihood of success. EPW Democratic staff approached HPBA with potential compromise language, but an agreement could not be reached, especially on language that would have prevented EPA from making any changes to the NSPS in the future.
